When is a DOT reasonable suspicion test required?

Employers must test a driver when a trained supervisor has reasonable suspicion of drug use or alcohol misuse. The request must be based on specific, contemporaneous, articulable observations of appearance, behavior, speech, or body odor.

Who can send a driver for this test?

A supervisor trained to detect symptoms of impairment. Employers must train CDL driver supervisors for this. (§382.603). A reasonable suspicion alcohol test cannot be based only on a third-party report — a trained supervisor must personally observe the indicators.

How soon does the test have to happen?

FMCSA says drivers who appear under the influence can be immediately tested. For alcohol, if the test is not done within 2 hours the employer must record why; if it is not done within 8 hours, stop trying and record why.

Is this the same as a random or post-accident test?

No. Reasonable suspicion is its own DOT test reason, based on a trained supervisor's observations, not a crash chart or a random draw. (§382.307)
